Law and Injuries Explained: When a Driver Pulled Out of a Driveway and Hit You

Driver Pulled out of a Driveway and Hit Me

One of the riskiest places for a car accident is when a motor vehicle has to pull out of a driveway or parking lot.  This merging onto a roadway is what is incredibly dangerous because it places one vehicle directly in the right-of-way of another vehicle.  Not only for the vehicle pulling out of the driveway, but also for drivers coming down the roadway.  In fact, the risk is very high for motorists coming down the road because a vehicle that jets out of a driveway between parked cars could give motorists just seconds to avoid a collision.  That could result in a catastrophic or deadly collision.  Thus, when a driver pulled out of a driveway and hit another motorist, it can result in liability for the vehicle merging onto the public roadway.

This can be a frustrating and confusing type of accident because the driver of a vehicle leaving the driveway could blame you for the collision.  That driver’s insurance company is also likely to blame you for the collision too, usually claiming you were distracted, braked too slow, were speeding, or otherwise causes the collision.  But this is not fair.  Our Queens car accident lawyers at COHEN & COHEN PERSONAL INJURY LAWYERS, P.C. know that this is not fair.  This is why we have helped protect the rights of victims of motor vehicle accidents throughout New York City, Queens, Long Island, and anywhere else in New York.  If you or a loved one were seriously injured when a driver pulled out of a driveway and hit you, please call for a FREE consultation to learn what your rights to compensation may be under New York law.

Liability When a Driver Pulls Out of a Private Driveway and Hits You

The law is clear under New York Vehicle and Traffic Law section 1143.  A vehicle entering the roadway “shall yield the right of way to all vehicles approaching on the roadway to be entered or crossed.”  This section applies to all motor vehicles entering the roadway from:

  • A private driveway
  • Parking lot
  • Alleyway
  • Grass/off-street parking
  • Garage
  • Public turnoff
  • Roadway shoulder, or
  • Other similar roadway structures or pull offs.

This means that a motorist coming from any position off the roadway must yield to the right of way to all vehicles that are oncoming.

Injuries When a Motorist Pulls Out in Front of You

When a motorist pulls out in front of you from a private driveway, it usually means that you will either t-bone or rear end that vehicle.  This is because there is usually only a split-second before a collision and a vehicle pulling out from a private roadway is going to cut you off.  This means that certain types of injuries are most likely for you, which include the following:

  • Head injuries
  • Broken bones
  • Whiplash
  • Neck and back injuries
  • Nerve injuries including brachial plexus nerve injuries
  • Organ injuries
  • Traumatic brain injuries
  • Torn rotator cuffs
  • Knee injuries, and
  • Many other serious injuries.
